Specifically, Smith’s team is asking the Supreme Court to uphold a unanimous ruling from a D.C. Circuit panel that dismissed Trump’s claim of presidential immunity. Trump’s lawyers have argued that prosecuting the leading Republican candidate would violate the First Amendment rights of millions of American voters. Smith’s filing refutes this and also counters Trump’s argument that a former president cannot be prosecuted unless first impeached and convicted. The request also includes an expedited schedule with oral arguments in March if the court takes up the case, citing public interest in a “speedy and fair verdict.”
