Criminal Referrals of Hunter and James Biden Issued by House Republicans

The three House committee chairmen recommended the action in a criminal referral.

This move comes shortly after the conviction of former President Donald J. Trump on 34 felony counts. The charges against Hunter and James Biden include allegations of perjury and false statements about President Biden’s involvement in his family’s business affairs.

While these referrals carry no legal weight, House Republicans hope to influence the Justice Department to prosecute the Biden family further. Speaker Mike Johnson urged Attorney General Merrick B. Garland to take immediate action on these accusations.

“To prove there is no bias in justice, Attorney General Garland must open criminal investigations into James and Hunter Biden,” stated Johnson. Hunter Biden is currently on trial in Wilmington, Del., on charges of lying about his drug use on a federal form when purchasing a gun.

The referral also claims that Hunter Biden provided false statements about his position at Rosemont Seneca Bohai, a firm that received millions from foreign individuals. He denied holding the position of “corporate secretary” at the firm, a claim contradicted by members of his legal team and business partner Devon Archer.

The referral also accuses Hunter Biden of providing misleading information about threatening WhatsApp messages he sent to a business partner. Republicans allege that James Biden lied to Congress when he denied that Joseph R. Biden Jr. met with Hunter Biden’s business associate Tony Bobulinski in 2017.

James Biden’s lawyer dismissed the congressional referral as a baseless partisan action. Hunter Biden’s lawyer denied the accusations, calling them a desperate attempt by Republicans to interfere with his trial.

Republicans have been unsuccessful in tying Hunter Biden’s alleged criminal misconduct to his father, leading them to shift their strategy towards making criminal referrals. These referrals do not require a vote of Congress, providing an easier route for House Republicans.

Representative Jamie Raskin commented that this shift indicates the end of the GOP’s impeachment investigation into President Biden. The use of criminal referrals mirrors a strategy previously employed by Democrats in the last Congress during their investigation into the Jan. 6, 2021, attack on the Capitol.
