Celebrity tattoo artist Kat Von D won a copyright lawsuit where photographer Jeffrey Sedlik accused her of using his portrait of jazz legend Miles Davis without permission. After just over two hours of deliberation, a Los Angeles jury concluded that the tattoo was not similar enough to Sedlik’s 1989 photograph to necessitate paid permission. Other social media posts included in the lawsuit that contained Sedlik’s photo were regarded by the jurors as falling within the legal doctrine of fair use. Sedlik’s attorney, Robert Edward Allen, indicated an intent to appeal. The decision is seen as a victory for Von D and tattoo artists in general.
